Cisco sues Apple

Cisco accused Apple in a suit filed in United States District Court for the Northern District of California of willingly infringing its trademark when it announced the new iPhone at the Macworld Expo in San Francisco on Tuesday. Apple tried to get the rights to the iPhone name several times before but failed. Cisco and Apple are set to make a deal on a way they can both use the iPhone name. If Cisco goes to court with Apple, Apple is confident they will prevail. There are already several companies using the iPhone name, and Apple is the only one who is using it for a cell phone. Apple applied to use the trademark in the U.S. on September 26, 2006 using a Wilmington, Del.-based front company called Ocean Telecom Services.

Apple iPhones Enter Cingular Wireless Lineup

There is an old adage in business that states that when a market is hugely competitive--as is the cell phone market--the winner ends up being the customer. The cell phone offerings in the last few years have definitely proved this theory, first with super-sleek phones like the RAZR, then with mean music machines like the Sony Walkman phone and now with the Apple iPhone swelling the ranks of what customers can choose from.

Apple is a company well known to the American consumer. The Macintosh computer and the iTunes-iPod combination are two examples of two instances when Apple has hit a home-run with the buying public. Now, the new Apple iPhone also promises to be a good decision on the part of this company. Partnering with Cingular, Apple is launching a product that may very well change the competitive landscape of the cell phone market.

The iPhone Cell Phone Essentials

The iPhone is advertised as being three things in one. On the outside, it has the familiar look of a wide-screen iPod, whose music functions it shares with its dedicated cousin. Also, the iPhone has a full-featured built-in web browser that allows the user to surf the 'net and view the pages on the handset's rather large screen. And naturally, the iPhone is also a cell phone. So we have 1) a music player with the familiar looks and feel of an iPod; 2) a full-featured web browser and 3) a cell phone all built into one device.

One of the things that Apple is touting as being a user-friendly innovation is the iPhone cell phone's totally menu-driven format. If you are familiar with an iPod, you'll immediately recognize this: pretty much everything on the iPhone works like the menu of your iPod, where you use your thumb to scroll through lists in which you can make your selection. While this may not be a breakthrough per se, it is refreshing to see that Apple has adapted it to voicemail messages. In other words, with the iPhone, you can not only scroll through the phone's functions (as you can with other cell phones); but also, you can scroll through your voicemail messages, which you see displayed one after the other in the menu, and select the one you want to listen to.

Analyst: Hold The iPhone

Despite its gorgeous display and addictive appeal, Apple's (Quote) iPhone isn't an instant home run just yet. For starters, there's the name problem.

Cisco Systems (Quote) filed suit against Apple in the Northern District of California today, seeking an injunction against Apple using Cisco's iPhone trademark with its latest product.

Cisco said it obtained the iPhone trademark in 2000 after completing the acquisition of Infogear, which previously owned the mark and sold iPhone products for several years. Cisco's Lynksys division also recently launched a new series of dual phones that connect traditional calls as well as Internet-based telephony.

The suit came after Apple apparently went ahead and launched the iPhone before negotiations with Cisco over the trademark were finalized.

"Cisco entered into negotiations with Apple in good faith after Apple repeatedly asked permission to use Cisco's iPhone name," said Mark Chandler, senior vice president and general counsel for Cisco. "There is no doubt that Apple's new phone is very exciting, but they should not be using our trademark without our permission.

The negotiations continued up until the night before the iPhone's release, according to a Cisco spokesman, John Noh. "As of this morning, we have not received the approved agreement from them," he told internetnews.com.

Apple was not immediately available for comment.

In addition to the legal question, analysts noted that it would be a while yet before the phone causes sleepless nights for cell phone giants.

"As beautiful as the iPhone design is, physical design isn't what handset vendors are lacking," Current Analysis analyst Avi Greengart told internetnews.com

After the iPhone -- which combines iPod functionality with a touch-screen smartphone -- is available this summer, "there will be some reevaluation of the usefulness in the market," Greengart said.

Goldman Sachs enthusiastically said the iPhone's introduction was "setting the bar higher for competitors to hurdle," but the Wall Street analyst questioned whether consumers will accept the product.

Analysts said the iPhone won't hurt RIM's prosumer Pearl. Research in Motion, (Quote)maker of the BlackBerry e-mail device, saw its stock drop 8 percent following the iPhone's introduction. However, by mid-morning, RIM stock had rebounded, rising nearly 2 percent.

While the iPhone will be popular with some consumers, for a number of reasons, the handset "will have very little impact on the business community," according to Greengart.

Convergence of the iPod with a phone will not be important, particularly in companies hesitant to buy a consumer-oriented device, Kitty Weldon, analyst with Current Analysis said.

The touch-screen design will turn off business people accustomed to buttons. Although the iPhone's design is very efficient, Greengart said few devices in the U.S. have been all touch.

Unlike the BlackBerry, the iPhone doesn't include secure corporate e-mail or other corporate-level controls, according to the analyst.

And unlike the Treo, the iPhone can't import applications, and the Apple device lacks 3G support, as well as mobile TV capabilities offered by a number of carriers.

Even with its new design, the iPhone lacks the user base to compete with cell phone giant Nokia.

Palm's (Quote)reo and Sony Ericsson are Apple's closest competitors, he said. Palm has held the lead in design innovation, and Ericsson sells touch-screen units in Europe.

"A lot of the innovation we see on the iPhone we've seen first on the Treo," Greengart said. Compared with Ericsson, the iPhone offers smoother on-screen scrolling.

The iPhone's introduction "makes the incredibly crowded smartphone market even more crowded," Greengart said.

Apple shares reached 97.22 in afternoon trading, up more than 5 percent from the morning, before the lawsuit by Cisco became official.

Before release, everyone anticipated the iPhone with restlessness, and then with great reviews under its belt, the gadget became the center of attention in today's high-tech universe. What's funny to me is that everyone's pointing out only the upsides of the iPhone (probably because they want to sell it to you). I believe the iPhone is very neat, but is it worth the money or a rip-off? That's what I'm here to tell you. One major downside and complaint of the Apple iPhone is its battery's life. Because of the high-tech features such as multi-touch technology, revolutionary sensors, and nearly the same operating system as in the Mac, the battery is drained easily. Truth is Apple released the iPhone before creating a top-tier battery. iPhone exclusively using AT&T's Edge is yet another major complaint. The data network is sluggish compared to other more developed networks today. Apple has claimed this feature isn't a major drawback, well, because the gadget had been designed to be notorious about receiving broadband connection via Wi-Fi Hotspots. Simply, the network is slower than what you're used to with your computer. The iPhone doesn't support the sophisticated 3G technology for no particular reason. It's a mystery. MMS functions aren't even provided in the iPhone. Nor are voice dialing or recording. This means that it's only a dual-band mobile phone. Tackling messaging, there is no instant messaging. Therefore, you'll have to stick to plain and simple e-mails. This can be a drag in the business setting. And what makes matters worse, you can't copy and paste important data. The iPhone doesn't have a memory slot at all. Apple claims there is sufficient built in memory, yet consumers today expect to have the feature of external memory. We've never seen anything like it, but is it in comparison worth the money? If you need the best there is then possibly. It's a nice toy but may not be as valuable as priced. The gadget's value also depends on what you'll be using it for. If you're a businessman, you might want to stick to your current PDA until the Apple iPhone is upgraded. If you're looking for the most high-tech, hottest toy on the market that you can use to surf the internet anywhere (for entertainment purposes) it may be worth the investment for you.
